TOWN OF WEATHERSFIELD, VERMONT

PLANNING COMMISSION

Monday, May 12, 2008

 

I. Introductions:

Commission members present were Peter Daniels, Bruce Cox, Ed Williams, and deForest Bearse (Land Use Administrator).

The audience members present were Marion Ballam, Victor St. Pierre, Mark Thompson, Scott and Terry Smead, Christopher Charest, Gary Lynch, Rodney Cole, Paul Tillman, Nancy Fairbrother, and Christopher Paton.

II. Approval of Minutes: Meeting of April 14, 2008

Ed Williams made a motion to accept the minutes of March 24, 2008 as written. Bruce Cox seconded it. All were unanimous.

III. Review Meeting Agenda – additions, corrections

There were none.

IV. Public Hearings:

Final Plat Reviews

(1) App. #04.0708 by Five Eagles Design LLC for amendment to final plat #10.2005

Chairman Daniels opened the hearing at 7:05. Victor St. Pierre stated that he has placed the right of way line in compliance with the setback requirements. He has spoken with Paul Tillman about it and he was fine with it. It is still in compliance with the waste water permit. This is the last thing to do before it can be put on the market.

deForest Bearse stated that it has been rotated slightly, but it was either move the right of way or the foundation. It will need to be corrected on the mylar. Paul Tillman stated that there will be no new pin for right of way. He wanted to know if there is a site visit after a permit has been issued for a house. deForest Bearse stated that the Select Board would like her to give a Certificate of Occupancy for all zoning permits.

Ed Williams made a motion to approve the right of way adjustment as shown on Harrington/Morgan drawing dated 4-22-08 by Farnsworth Survey drawing #05.1779 amendment to final plat 10.2005. Bruce Cox seconded it. All were unanimous.

V. Requests/Reviews:

A. Sketch Plan Review

(1) #04.2808 by Neil Daniels, Inc. for a 5-lot subdivision on Roberts Road

Peter Daniels stepped down due to conflict of interest. Bruce Cox was acting chairperson. This subdivision will be 19.78 acres with lots ranging from 3.21 to 4.73 acres.

Christopher Paton stated that there is frontage on Roberts Road and they have approved septic designs by the State of Vermont. The proposed house, well, driveway, and setbacks of brooks and streams are shown. deForest Bearse stated that Lot 5 has soil of statewide significance. Ed Williams read the Conservation Commission letter dated March 5, 2006.

Gary Lynch stated that when there is a major storm, he is worried that sewage will leak onto his property and into the brook. Christopher Paton said that the septic system meets the setback from Blood Brook and the buffer is 100 feet between the brook and the primary leach field. It is based upon slope according to the rules of Weathersfield and the width of the channel.

Bruce Cox went over the checklist. The Commission needs to know the location of poles and what trees will need to be cut, list the slopes in the area where agricultural soils are mapped, map significant soils, erosion control plan according to the low impact handbook, and check on the flood insurance map for Flood Brook.

VI. Discussions:

Bylaw/Regulations Revisions

Finish revisions to section 6.10.7, Agricultural Zoning

The Commission discussed this and will continue discussing this at their next meeting on May 19, 2008.

VIII. Adjournment:

Ed Williams made a motion to adjourn the meeting at 9:40. Bruce Cox seconded it. All were unanimous to adjourn.
