TOWN OF WEATHERSFIELD, VERMONT PLANNING COMMISSION Monday, June 9, 2008 I.   Roll Call: Commission members present were Peter Daniels, Bruce Cox, Ed Williams, and deForest Bearse (Land Use Administrator). The audience members present were Frank Manafort, Matthew D. Priestley, Jay Stevens, Gary Rapanotti, Chris Charest, Scott and Terry Smead, Anstis G. Benfield, Stanley Hodgeman, William Handly, Lyle and Harriet Wood, and Gilbert Whittemore. II.   Approval of Minutes: Meeting of May 12, 2008    Ed Williams made a motion to accept the minutes of May 12, 2008 with corrections. Bruce Cox seconded it. All were unanimous to accept the minutes with the corrections. III.   Review Meeting Agenda- additions, corrections IV.   Public Hearings: A. Final Plat Reviews (1) #05.0908 by Sara DeGennaro and Jay Stevens for a 3-lot subdivision on Mountain View Road Gary Rapanotti and Jay Stevens were sworn in and there was no conflict of interest. The Commission wanted the following change; change “merged†to “annexed†on 2.3, remove deferral language on 2.3, add stamp and signature of surveyor to mylar, and add signature block. The hearing was closed.     Bruce Cox made a motion to approve with the corrections “05.0908 by Sara DeGennaro and Jay Stevens dated April 21, 2008 (to be revised June 10, 2008). Ed Williams seconded the motion. All were in favor. (2) #05.1508 by Matthew and Cynthia Alldredge for a 3-lot subdivision on Divoll Pasture Road They would like to continue this hearing on July 14, 2008. (3) #05.1308 by F & L Ventures for a 2-lot subdivision on Weathersfield Center Road Gary Rapanotti, Matthew Priestly, and Frank Manafort were sworn in. Ed Williams is a neighbor and an abutter, but feels that he will not have any conflict of interest. The rookery is mapped and the topographical contours are shown in metric. The existing sheds do not meet the required setbacks. The power poles shown are existing. The shed was built five years ago.  Ed Williams made a motion to approve the final plat #05.1308 for 174.08 acres as shown currently on Gary Rapanotti project 08-916 dated May 5, 2008 revised June 10, 2008. They need to correct the location of the movable sheds on Lot 1 and 2, the boundary lines need to be adjusted on the SE to less than one acre, bring the machine shed into compliance with the Town of Weathersfield setback requirements, correct the spelling for Weathersfield Center Road, and show the north arrow. Bruce Cox seconded it. All were unanimous.  (4) Sign mylar for Five Eagles Design LLC Chairman Daniels signed the mylar. V. Requests/Reviews: A. Sketch Plan Review (1) #05.2708 by Dorothy Whittemore for a 2-lot subdivision on Upper Falls Road Gilbert Whittemore, son of Dorothy Whittemore, stated that the land would go into a family trust. The house lot will be a life estate and was built in 1996. Peter Daniels stated that they would need a deferral of development rights for the larger lot on the mylar       Ed Williams read the Conservation Commission letter. Lot 2 is in the 100 year flood plain and there is a wetland in the north end.       Peter Daniels went over the checklist. They need to show the following; existing well and leach field on Lot 1, the contours, the existing driveway, the 550 Corp of Engineering easement, the flood plain on Lot 2, and a deferral of development rights for Lot 2. Bruce Cox made a motion to classify this as a minor. Ed Williams seconded it.  VI. Discussions: A. Bylaw/regulation Revisions: Sect. 6.10.7 Agricultural Zoning-final wording Section 6.10.7 Agricultural Zoning Proposed language: Prime land identified by the Natural Resources Conservation Services (NCRS) as “P – prime†or “S – significant†and as described in the Farmland Classification System for Vermont Soils, published by the United State Department of Agriculture (USDA) – NRCS and available at www.nrb.state.vt.us/lup/publicayions/importantfarmlands. pdf, is land to be preserved. These lands are shown on the map. “Important Farmland Soils, Weathersfield, Vermont†printed by Southern Windsor County Regional Planning Commission (SWCRPC) based on data provided by the USDA. Additional information can be obtained from the USDA Websoil Survey at http://websoilsurvey.nrcs.usda.gov/app/. Land used on P- or S- designated soils other than agricultural or forestry shall require a conditional use permit from the Zoning Board of Adjustment. The Zoning Board shall condition the proposed land use so as to maximize preservation of the protected soils. In no event shall the total area of impermeable surfaces on the P- or S- designated soils – existing and proposed combined – exceed 10% of the total area of the mapped protected soils on the parcel. A conditional use permit shall not be required when an attached addition to an existing building is proposed that will not result in greater than 10% impermeable surface on the protected soil or on lots which contain three (3) or less acres of contiguous P- or S- designated soils.  Impermeable surface is defined for the purpose of this bylaw as any manmade surface including, but not limited to, paved and unpaved roads, parking areas, roofs, driveways, walkways, decks and pools that disturb the soil such that is no longer useable for agricultural purposes. Bruce Cox made a motion that we accept the proposed language for 6.10.7 as amended this evening and pass along to the Select Board. Ed Williams seconded it. All were unanimous to accept the amended language for 6.10.7. VII.   Public Comment:    There was none.  VII.   Adjournment: Bruce Cox made a motion to adjourn the meeting at 9:30. Ed Williams seconded it. All were unanimous to adjourn.
