TOWN OF WEATHERSFIELD, VERMONT PLANNING COMMISSION Monday, October 24, 2011
I. Introductions:
Commission members present were Michael Todd, Bruce Cox, Alan Hudson, Gil Whittemore, Julia Lloyd Wright (ex-officio), and deForest Bearse (Land Use Administrator).
There were no audience members.
Bruce Cox opened the meeting at 7:00 PM.
II. Approval of Minutes: Meeting of September 26, 2011
Alan Hudson made a motion to approve the minutes of September 26, 2011 with corrections. Gil Whittemore seconded it. All were unanimous.
III. Review Meeting Agenda - additions, correction
Gil Whittemore asked deForest Bearse for an update on the Bylaws with the Select Board. Alan Hudson stated that the Select Board might want the Commission to review the stream bank bylaw since Irene. Michael Todd stated that the Bylaw addresses the stream bank conservation. Gil Whittemore would like the Commission to wait till the spring after the State has their data. The Agency of Natural Resources is currently looking at it. Michael Todd stated that the progress on Route 106 is great. It should be open by December 1st. deForest Bearse stated that in the early stages Gurney Brothers were to get the river out of the way with no plan. Dave Fuller was concerned with his land because when the stream is moved, it could affect other areas of land. deForest Bearse said that the planning and zoning budget will be discussed at the Select Board meeting on November 1, 2011. She put in $3000 for the land use chapter.
IV. Discussions:
A. Bylaw/Regulations Revisions
(1) 9.2.2 (12) Exempt structures The Commission reviewed the latest draft date 9/26/22 from deForest Bearse. Michael Todd made a motion to accept the language on 9.2.2 (12 accessory structures) as amended on October 24, 2011. Alan Hudson seconded it. All were unanimous.
(2) Deferral of Development Rights (subdivision regulations)
(3) Section 6.12 Height Limitations Alan Hudson presented the Commission with a copy of an article from the Rutland Herald in regards to height of buildings in Colchester. The Commission discussed this bylaw. deForest Bearse will draft the changes for height limitations, adding definition and height diagram, and delete 6.12. Michael Todd made a motion to approve height limitations pending the Gil Whittemore seconded it. All were unanimous.
(4) Nonconforming Uses The Commission discussed the draft from deForest Bearse. They discussed the time length and language. The Commission considered this new sentence - Time spent on any appeal of a decision regarding a zoning permit application to re-establish a non-conforming use shall be added to the ______ year period. The Commission decided upon three years with language. They will review it at their next meeting.
(5) Home Businesses
(6) Interested Persons The Commission reviewed the State Statute 9.3.2. Gil Whittemore suggested new wording for 9.3.3 - Neither the Zoning Administrator nor any party to the appeal shall be obligated to respond to any grounds for appeal not stated in writing in the notice of appeal. He stated that it could be a new paragraph. This will be continued at the next meeting with deForest Bearse's draft. It will be the first item on the agenda.

B. Town Plan Revisions Michael Todd made a motion to table the Town Plan revisions. Gil Whittemore seconded it. All were unanimous. (1) Energy Chapter (2) Land Use Chapter
VI. Public Comment: There were none.
VII. Set or reinforce the agenda, date, time, and place for the next meeting The Commission will review the final language for height limitations and the diagram, nonconforming use final language, interested person, Town Plan, and the Energy Chapter.
VIII. Adjournment: Michael Todd made a motion to adjourn at 9:05PM. Gil Whittemore seconded it. All were unanimous.
